According to Article IX, “The United States in Congress assembled” had the sole power to determine peace and war, to send and receive ambassadors, and to make treaties and alliances. In reality, however, even in those few areas, Congress shared power with, or was subject to veto by, the states. Congress was forbidden from making treaties that restrained the individual states “from imposing such imposts and duties on foreigners, as their own people are subjected to, or from prohibiting the exportation or importation of any species of goods or commodities whatsoever” (Article IX).

This was not simply idle talk. He was frequently under fire during the campaign leading to the British occupation of Philadelphia in September–October 1777 and during the battle of Monmouth, New Jersey, in June 1778. In early 1781, he quit Washington’s staff and eventually joined a New York infantry regiment. During the decisive battle of Yorktown (October 1781), he led his bayonet-wielding battalion up the side of a British redoubt, forcing its abrupt surrender. Colonel Laurens, a cultivated, rashly brave South Carolinian, knew what Hamilton was talking about.
